What Miami HOA Boards Should Know

Community associations in Miami must follow Florida Law, along with local ordinances and city or county requirements. These include building recertification and safety and reserve study requirements, among others.

Building Recertification and Safety Inspections

Miami-Dade has a recertification program that covers buildings 30 years old and older, with repeat inspections every decade. Buildings covered by this program should be at least three stories tall and within three miles of the coastline to enter at 25 years. If your building is older, it may fall under earlier transition deadlines.

Recertification would typically involve structural and electrical inspections. Usually, Single-family homes and duplexes are exempt from this program. Buildings with only 10 or fewer occupants and an area of 2,000 sq ft or less are also exempt.

For your board: Confirm your building’s schedule for inspections with the City of Miami Building Department, maintain inspection reports, and budget for needed repairs.

Structural Integrity Reserve Studies

The state requires condominium associations to complete a reserve study at least every 10 years. This applies to buildings that have three or more habitable stories. The reserve study must assess specified building components and help set out a funding plan for repairs and replacements.

For your board: Confirm your association’s reserve study deadline, incorporate the funding plan into budget discussions, and explain how planned repairs may affect assessments.

Miami-Dade Community Association Registration

Miami-Dade requires condominium, cooperative, and homeowners associations to register and renew annually. The requirement applies throughout the county, including the City of Miami and other incorporated municipalities. The county has announced February 1, 2027, as the next registration or renewal deadline.

The registry provides centralized access to association information and certain documents that associations must maintain under Florida law.

For your board: assign responsibility for renewal, keep association and management information current, and gather the required documents before the deadline.

Florida Association Laws and Licensed Management

Chapter 718 of the Florida Statutes generally governs condominium associations, while qualifying homeowners associations fall under Chapter 720. Their governing documents also shape the board’s responsibilities.

Florida regulates paid community association management under Chapter 468. Licensing requirements depend on the services performed and the size or budget of the association or associations served. Management firms also must meet licensing requirements.

For your board: choose a company familiar with your association type, and verify that both the manager and firm hold the licenses required for the work.

FAQ

Miami HOA Management FAQ

What laws govern HOAs and condo associations in Miami?

Florida’s Condominium Act, Chapter 718, generally governs condominium associations. Chapter 720 governs qualifying homeowners associations. Associations must also follow their governing documents and applicable city and county requirements.

Do Miami condo associations need a structural integrity reserve study?

Generally, residential condominium associations must obtain a study at least every 10 years for each building with three or more habitable stories. The study supports funding for repairs and replacements and is distinct from a building safety inspection.

Do Miami associations have to register with the county?

Yes. Miami-Dade’s registry covers condominium, cooperative, and homeowners associations in incorporated and unincorporated areas. Registration must be renewed annually, with the next deadline set for February 1, 2027.

How much does HOA management cost in Miami City?

There is no universal dollar amount. Management fees can vary depending on the building’s size, amenities, services, and needs. Luxury high-rises, for instance, tend to have higher management fees than smaller condominiums with minimal amenities.

Is HOA Explore free for Miami City boards?

Yes. HOA Explore is free for boards, with no cost or commitment. Your board decides whether to hire any management company we introduce.
