What is an HOA proxy form?
It is a formal legal document that a homeowners association member signs to authorize another individual (known as the proxyholder) to represent them, count toward quorum, and cast votes on their behalf at an upcoming association meeting.
What is the difference between a general proxy and a directed proxy?
A general proxy gives your designated representative the authority to vote on any issue that arises during the meeting however they see fit. A directed proxy limits their power, requiring them to vote exactly as you have indicated in writing on the form (such as marking specific checkboxes for certain candidates or budget approvals).
Can a tenant act as a proxyholder for an owner?
Yes, in most cases, provided that your association’s bylaws do not explicitly restrict proxyholders to deeded homeowners. The owner must name the tenant as their custom proxyholder and sign the form to validate the arrangement.
Is a proxy form valid indefinitely?
No. A proxy form is typically only valid for the specific meeting listed on the form and any of its immediate continuations or adjournments.
