It is an official board-approved document that outlines the progressive warning steps and specific monetary penalties applied when homeowners violate the community’s governing rules.
Can an HOA issue a fine without warning?
In most states and under standard association bylaws, no. The board must first issue a formal written warning notice that identifies the violation and provides the resident with a reasonable amount of time to correct the issue.
What happens if an owner refuses to pay a fine?
Unpaid fines are typically added to the owner’s ledger and can accumulate late fees. If left unpaid, the association can suspend their access to community amenities, restrict voting rights, or even file a property lien depending on state laws and community CC&Rs.
