DC HOA Laws Update: What’s New in 2025?
The new HOA laws in DC center on the Association Meeting Flexibility Emergency Amendment Act of 2025, known as DC Act 26‑6. This emergency law updates the 1976 Condominium Act to allow virtual meetings and clarify electronic voting requirements.
DC Act 26‑6: Association Meeting Flexibility Emergency Amendment Act of 2025.

Under the DC Act 26-6, unit owners’ associations, executive boards, and committees can hold meetings via telephone conference, video conference, or similar electronic platforms. The technology must let each participant hear, be heard, and understand everyone else.
Everyone attending electronically counts toward the quorum. This makes virtual meetings a viable option, regardless of the association’s bylaws.
Additionally, meeting notices must include instructions or a link for how to join the electronic session. If the board plans to hold a vote at the meeting, it can send ballots along with the meeting notice and set a deadline for returning them.
Unit owners may submit electronic votes up to seven days before the meeting. Those votes are counted as if the owner were physically present.
This Act took effect immediately after approval by the Mayor. It remains in force for up to 90 days under DC emergency rules.
No Other New Laws
Apart from DC Act 26-6, there have been no other DC HOA laws changes. Still, associations would be wise to keep an eye out for legislative updates. It is not uncommon for legislators to propose bills that affect HOAs and condominiums in the area.
DC HOA Laws 2025 That Remain in Effect
While there is little activity in the legislative landscape for DC associations, some laws remain in effect.
Horizontal Property Act of the District of Columbia
The Horizontal Property Act applies to condominium developments created before March 29, 1977. It covers ownership rights, maintenance obligations, and governance for older condo associations.
DC Condominium Act
Enacted in 1976, the Condominium Act governs most condo associations formed after March 28, 1977. It sets rules on budgets, meetings, rule changes, owner rights, and board duties. It also defines meeting notice requirements and inspection of records.
Residential Real Property Seller Disclosures

The Residential Real Property Seller Disclosures statute requires sellers to provide public offering statements or property disclosure documents. This applies to buyers of units in a condo or planned community. Buyers can review the association’s CC&Rs and bylaws before closing.
Nonprofit Corporation Act of 2010
Many HOAs and condo associations operate as nonprofits. The Nonprofit Corporation Act of 2010 provides governance standards for director duties, records access, indemnification, and board procedures.
